Get a modern survey to replace old, historical surveys

Survey plans are used as the basis for a title to the land shown on the survey plan – that title is “guaranteed” at law as to the land shown in the survey plan.

Modern surveys plans are highly accurate and use coordinates and measurements to position and locate boundary markers. Modern survey plans that are certified by a licensed cadastral surveyor will support a “guaranteed” title.

Some historical survey plans are not regarded as sufficiently accurate to support a “guaranteed” title. The titles that rely on these old plans are marked as “Limited as to Parcels”, meaning that the District Land Registrar who issued the title was not satisfied that the parcels of land had been sufficiently defined or surveyed, or there was some uncertainty as to whether part of the owner’s entitlement had been extinguished by adverse possession.

The solution is to resurvey the land using modern survey techniques and raise a new title using the modern survey.
